Jumpstart Sleep Coaching Client Agreement
I look forward to working with you! As a Gentle Sleep Coach SM, I am dedicated to helping parents and children get a restful night’s sleep! I am deeply committed to helping you achieve your sleep goals. Together we will explore what you want and how to get there.
These terms are applicable for Private Sleep Coaching Services provided by Tulsa Pediatric Sleep Consulting, LLC to you, the Client (“Client” or “you”).
EXPECTATIONS OF COACHING
Coaching services are not in any way to be construed as, or a replacement for, medical advice. You understand that I am not a medical professional and can’t make medical diagnoses. You also understand that your child’s sleep patterns or difficulty sleeping may be symptomatic of a condition for which medical intervention or medical treatment is advised. If we have any reason to believe that your child’s sleep difficulties may be related to a medical condition, I may advise you to consult with your child’s doctor before beginning the sleep training plan we discuss. You are solely responsible for discussing any possible medical conditions with your child’s physician or other health professional. You understand that you assume primary responsibility for the health of your child and, to the extent permitted by law, you will not hold me or my practice responsible for any outcomes resulting from complications that are outside of my control.
As your coach, you can expect me to:
- Be a partner in helping your child sleep better.
- Provide encouragement and support.
- Respect the confidentiality of the agreements we make.
- Give you input and straight-forward feedback.
- Listen carefully to what you say.
I expect that you, as my client will:
- Take good notes during the consultation.
- Communicate openly and honestly with me about any questions and concerns about your child’s sleep, including any special needs, health issues, medical conditions, and/or emotional situations.
- Follow the American Academy of Pediatrics recommendations for safe sleep.
- Commit to the plan and carry out the steps in the sleep plan we develop with complete consistency. You acknowledge and understand that the sleep coaching program’s effectiveness depends upon consistent follow through both during and after training.
- Keep a sleep/wake/eating log during sleep training.
- Take ownership for your progress and your accomplishments.
- Keep me informed if you do not meet your goals and need to add follow up support.
- Not plan any travel for at least 3 weeks AFTER your child is consistently sleeping through the night.
THE OPTIMAL COACHING EXPERIENCE
You may choose between a 1.5 hour phone consultation, Facetime, or Zoom call. I will call you at the number listed on your Sleep History Form at the time of our consultation if you choose a phone or FaceTime call. If you choose Zoom, please meet me in my Zoom room at that time.
It is important that this time is distraction-free, so it is preferable that your child is not with you or has a babysitter. It is also preferable (though not mandatory) for both parents to be present at the consultation so you can be on the same page regarding the sleep coaching and helping your child learn to sleep better.
Your Sleep History Form must be filled out before booking. This form will help me understand your family’s sleep situation and your goals. Your timely completion of the Sleep History Form is essential so that I have the background information I need to adequately prepare for our meeting.
I will send an outline of your written plan approximately 15 minutes prior to our consultation. During the consultation I will ask you for any other information you would like to share that will help me complete the plan to improve your child’s sleep, discuss method options, and answer any questions you may have.
THE SYSTEM OF MONEY
The total for this package is $200 and is due at the beginning of our coaching agreement.
Refunds/Cancellations
Refunds: Your payment will not be refunded after your sleep plan has been sent to you (15-30 minutes prior to our consultation).
All consultations must be scheduled within one month of purchase. If you have not scheduled within this time frame, your payment will be refunded minus a $50 administrative fee. (Unless you have already received your sleep plan, in which case there will not be a refund.)
Cancellations: If you decide to cancel or reschedule the consultation I ask that you notify me at least 24 hours in advance so that I may offer your appointment time to another family.
If you cancel or reschedule your consultation with less than 24 hours notice, there will not be any refunds.
If you cancel after you have submitted your Sleep History Form but before I have sent your written sleep plan, I will keep a $50 cancellation fee and reimburse the rest.
You can only reschedule your consultation up to three times. If you do not honor your third appointment, your consultation will not be rescheduled and your package will be terminated without a refund.
This package does not include follow up support. If you would like to add follow up calls or emails you can purchase them individually for $25 each. Follow up calls are 15-20 minutes in duration. You may email me anytime to schedule a follow up. I will then send an invoice via PayPal to pay before our follow up. You have up to one year after the consultation to add follow up calls. If sleep support is needed after that year, a new Sleep History Form and consultation may be required.
Insurance. I do not accept insurance. You may request an invoice to submit to your insurance company but I cannot guarantee reimbursement for any fees or for expenses you may incur for the coaching sessions.
OWNERSHIP OF INTELLECTUAL PROPERTY
The coach owns all rights to intellectual property so it can’t be shared with others. This includes your child’s sleep plan.
RECORDINGS
Recordings of the consultation in the format of voice and/or video is prohibited. Any recordings will result in the termination of the remainder of the consultation and/or any follow-up support, without a refund.
PRIVATE CLIENT ACCESS
Everything we will be using in this coaching experience (tools, forms, documents, resources, etc.) will all be housed conveniently on a secured and confidential "Private Client Website". Upon enrolling for the coaching experience, you will be given a unique username and password. At your convenience you may access this "Private Client Website" area to access, review and/or update the tools, documents, resources, etc. that we'll be using through our coaching. I will provide you with the access information and further instructions once we begin coaching.
THE SYSTEM OF CONFIDENTIALITY
The Coach represents, warrants and agrees as follows: All information provided by the Client to the Coach during the course of the coaching relationship will be deemed "Confidential Information" and kept strictly confidential unless otherwise agreed in writing. The Coach will not disclose any communications, either verbal or written, that have taken place either between the Coach and the Client or with regard to this Agreement without the prior written consent of the Client. This confidentiality restriction also applies to testimonials, which the Coach may use for promotional reasons only with the consent of the Client. The Client may request anonymity in connection with any testimonials to be used.
Notwithstanding the foregoing, "Confidential Information" does not include information that is:
(a) previously known to the Coach prior to discussions regarding this Agreement, free from any obligation to keep it confidential, or
(b) publicly disclosed by the Client either prior to or subsequent to the receipt by the Coach of such information, or
(c) independently developed by the Coach without any access to Confidential Information, or
(d) rightfully obtained by the Coach from a third party lawfully in possession of Confidential Information who is not bound by confidentiality obligations to the Client.
The Coach may disclose Confidential Information if required to do so under applicable law, rule or order; provided that the Coach, where reasonably practicable and to the extent legally permissible, provides the Client with prior written notice of the required disclosure.
